This incident is one of several that have brought safety concerns and regulatory questions into sharp focus, raising the stakes for both Tesla and the autonomous vehicle (AV) industry at large. Tesla’s FSD system, which aims to be a leader in the field, is at the center of this debate.
In the United States, there are no federal regulations specific to autonomous vehicles (AVs). Instead, they must comply with broader vehicle safety standards, leaving much of the regulation up to individual states. The NHTSA has primarily acted as an oversight agency, responding to incidents and issuing recalls when safety concerns arise, rather than proactively regulating the technology.
States like California and Texas have developed their own guidelines and requirements for testing and deploying AVs. The regulatory complexity only grows with new ambitions—like Tesla’s recent announcement of a robotaxi that operates without a steering wheel or pedals, which the company aims to deploy by 2026. For now, Tesla and other companies operate in an environment where many safety standards are still uncharted, especially when it comes to AVs operating in real-world scenarios.
Recent Incidents and Concerns with Tesla’s “Full Self-Driving”
The latest investigation was prompted by a series of four accidents in low-visibility situations—such as fog, sun glare, and airborne dust—one of which tragically killed a pedestrian. This probe is unique because it moves beyond driver attention issues, instead focusing directly on the capability of FSD to detect and appropriately respond to visibility challenges.
This isn’t the first time Tesla’s FSD has come under fire. Previous recalls addressed issues where FSD was reportedly programmed to roll through stop signs at low speeds and sometimes failed to obey other traffic laws. Tesla has addressed these concerns with over-the-air software updates, but the recurring incidents reveal potential gaps in the system’s hazard detection capabilities.
Tesla’s FSD relies solely on cameras, whereas most other AV companies also use radar and LiDAR for enhanced perception, especially in low-visibility scenarios. Critics argue that a more comprehensive sensor suite could improve detection and reaction capabilities, potentially reducing the risk of accidents.
The Future of Self-Driving Regulations
As autonomous driving technology advances, there is increasing pressure on regulators to set safety standards specific to AVs. While the NHTSA has historically acted after incidents occur, the current Tesla investigation signals a potential shift toward a more proactive regulatory approach, scrutinizing the underlying capabilities of autonomous systems. Michael Brooks, executive director of the nonprofit Center for Auto Safety, said the previous investigation of Autopilot didn’t look at why the Teslas weren’t seeing and stopping for emergency vehicles.
“Before they were kind of putting the onus on the driver rather than the car,” he said. “Here they’re saying these systems are not capable of appropriately detecting safety hazards whether the drivers are paying attention or not.”
